Consumer Protection, your questions, answered
Who counts as a consumer under the Act?
Broadly, a person who buys goods or avails services for consideration, for their own use rather than for resale or commercial purposes. The 2019 Act expressly covers online and teleshopping transactions. Whether a particular purchase qualifies can turn on the facts, and we'll assess that at the outset.
Which Commission do I file before?
Jurisdiction is tiered between the District, State and National Commissions according to the value of the goods or services paid for, with the State and National Commissions also hearing appeals from below. We identify the correct forum before filing, since a complaint in the wrong forum costs time.
Is there a time limit for filing a complaint?
Yes. A consumer complaint must ordinarily be filed within two years of the cause of action arising, though the Commission may condone delay where sufficient cause is shown. Speak to us early rather than late.
What relief can a Consumer Commission grant?
Depending on the case, a Commission can order removal of the defect, replacement of goods, refund of the price, compensation for loss or injury, discontinuation of an unfair trade practice, and costs. We'll set out what is realistically available on your facts.
Do I need a lawyer to file a consumer complaint?
The forum was designed to be accessible and you may appear in person. That said, framing the complaint, pleading the right relief and putting the evidence in properly makes a real difference to the outcome, particularly where the other side is represented.
