Who owns the copyright in a film or a piece of commissioned content?
It depends on the arrangement and what was agreed in writing. Different contributions carry different rights, and commissioning or employment can change the position. The safe course is an express written assignment or licence from every contributor, which is what we put in place.
What is a synchronisation licence?
It is the permission needed to use a musical work in timed relation with visual content, such as a film, advertisement or online video. Using a recording usually requires clearing both the underlying composition and the sound recording, from different rights holders. We identify who has to sign and obtain the clearances.
Do influencer and brand collaborations need a written agreement?
Yes. The agreement should cover the deliverables and posting schedule, usage rights over the content and for how long the brand may use it, exclusivity, approval rights, disclosure of the paid partnership, and what happens if a post has to be taken down. We draft these for both creators and brands.
What can I do about content that defames me or my business?
Options include a legal notice, a takedown request to the platform or intermediary hosting the content, and civil proceedings for defamation, with criminal remedies available in some circumstances. We assess the content and the likely response before choosing the route, since the wrong step can amplify the issue.
How do takedowns of infringing content work?
Where content infringes copyright or is otherwise unlawful, a request can be made to the platform or intermediary hosting it under the framework of the Information Technology Act, 2000 and the rules made under it, supported by proof of your rights. Where that is ignored or the infringement is serious, court relief may be needed.
Should I register copyright in my film, script or music?
Copyright arises on creation, but registration under the Copyright Act, 1957 gives you an official record and strong evidence of ownership, which makes licensing conversations and enforcement considerably easier. We advise on what to register and in which category.
