What does a design registration protect?

It protects the visual appearance of a product, its shape, configuration, pattern or ornamentation, not how it works or what it's made of. Functional features are protected through patents, not designs.

What makes a design registrable?

Under the Designs Act, 2000 a design must be new or original, not previously published or used, and significantly distinguishable from known designs. We run a search to assess this before filing.

How long does design protection last in India?

A registered design is protected for 10 years from registration, extendable by a further 5 years on payment of the renewal fee, up to 15 years in total. We manage the renewal so it doesn't lapse.

Can I protect both the look and the function of my product?

Often yes, through different rights, a design registration for the appearance and a patent for the technical function. In your consultation we'll map which rights fit your product.

Should I register before launching my product?

Generally yes. A design must be new and not previously disclosed, so registering before public launch protects novelty. If you've already launched, talk to us promptly so we can advise on your options.
